End-of-Year Bonus and the 13th Cheque: What's the Deal?
As the year wraps up, many of us eagerly anticipate the festive gatherings, holidays, and spending precious moments with our loved ones. And with all the excitement and travelling, who wouldn't appreciate a bit of extra cash to make the season even merrier?
Everyone knows about the end-of-year bonus or the 13th cheque. But, is everyone entitled to this festive financial boost? Are you entitled to it? Let's break it down.
Understanding the Bonus/13th Cheque
Simply put, a bonus is an extra payment over and above your regular salary, usually given as a reward or incentive. However, it's essential to note that not everyone automatically gets a bonus.
So, are you in line for that bonus?
The law doesn't specifically mention the payment of bonuses. This means it's mostly up to the employer's discretion, but there's a catch. If your employment contract or a collective agreement mentions a bonus, then voila! It becomes your right, and the employer is bound to honour that commitment.
However, if an employer decides for whatever reason not to grant the bonus, they must communicate this with the employees. If the company has solid reasons for this decision and has consulted with employees, they can choose not to pay, even if all employees do not agree with this decision.
Let's look at an example: Imagine your company guarantees a year-end bonus if certain financial goals are met. These goals are achieved, but the employer does not want to pay the agreed bonus. You, the employee, might have the right to claim a breach of contract.
In a nutshell:
- The law doesn’t mandate bonuses and labour law does not directly oversee bonuses.
- If an employer guarantees a bonus either in an employment contract or company policy, they should fulfil it.
- Not providing a promised bonus could lead to legal consequences.

From 1 January 2024, Scorpion’s funeral plan underwriter will change from Hollard to Family Insurance, and there are some modifications to the Funeral Plan policy document wording.

The Scorpion funeral plan you know and trust isn't changing. Your benefits remain the same, and there's no extra cost. Until 31 December 2023, Hollard will continue to handle all your benefits. And while there are no immediate changes on the cards post-change, we're always looking at ways to serve you better, so occasional reviews in the future are likely.
