Success Story
Mr Radebe (not his real name), a loyal member of Scorpion Legal Protection, decided to reward himself with his dream car; a Ford Ranger. But within a month of the purchase, the car began to show mechanical defects. Mr Radebe had the further misfortune of taking his car to be fixed by someone who then mixed coolant and water, which caused major damage to his engine. Poor Mr Radebe. He ended up having to spend over R99 000 for the repairs.
Eish, at this point, Mr Radebe was feeling very disappointed and frustrated. He reached out to the seller for help, but the seller refused to help in any way. Luckily, there was light at the end of Mr Radebe’s dark tunnel – he remembered that he is a member of Scorpion Legal Protection! He contacted us, and our team helped him strike back legally.
Our Intervention
Our diligent legal counsellor stepped in to represent Mr Radebe’s interests. After attempting to engage with the seller, who remained uncooperative, our legal counsellor issued a letter of demand (LOD) to the dealer explaining how their conduct was in breach of the Consumer Protection Act, which states that consumers have a right to receive goods of good quality, free from defects, and in working order. Additionally, the Act provides a six-month implied warranty against mechanical defects for vehicles purchased from dealerships.
The Resolution
The seller acknowledged receipt of the letter of demand and subsequently agreed
to refund the member for the faulty vehicle. Success!
This outcome reaffirms the importance of knowing and asserting your rights as a consumer and highlights the effectiveness of seeking legal guidance when faced with disputes.
