Voetstoots doesn't mean dishonest sellers can just get away with selling defective goods – the Consumer Protection Act is there to protect buyers. The law allows for buyers to cancel the contract or sue the seller for a lower selling price if:
- the article had the defect at the time of the sale
- the seller knew of the defect
- the seller did not disclose the defect
- the seller deliberately hid the defect knowing that if the buyer saw it, he (the buyer), would either not have continued the purchase or would have negotiated a better price
- The seller knew of the defects and did not tell the buyer about them
- The seller misrepresented the article, whether fraudulently or not.
